Subject: LGOIMA request - Tarawera Reticulation Scheme - unsuitable OSET properties
I refer to your LGOIMA request of 1 October 2023 for a list of the 170 properties at Lake Tarawera which are unsuitable for installation of OSET systems, and referring to a study undertaken in 2017 by Louise Feathers Planning.
This study was commissioned by Bay of Plenty Regional Council (BOPRC) and was presented to a meeting of the Tarawera Sewerage Steering Group on 30 October 2017 (copy of report attached).
RLC does not hold a list of the properties that are unsuitable to meet the requirements of the OSET Plan, referred to on page 22 of the report. This part of your request is therefore declined under s17(e) of the Act.
However, Section 12 of the Local Government Official Information and Meetings Act 1987 (LGOIMA) provides that a request for information must be transferred if some or all of the information:
- Is not held by the agency, but is believed by the person dealing with the request to be held by another agency; or
- Is believed by the person dealing with the request to be more closely connected with the functions of another agency.
As the report and associated property information was commissioned by BOPRC, RLC has transferred your request for the list of properties to BOPRC.
