Subject: LGOIMA request - CE performance reviews

I refer to your Local Government Official Information and Meetings Act (‘the Act’) request of 15 March 2023 for the last two performance reviews of the Chief Executive (CE).

The CE’s performance reviews are undertaken between the employee (CE) and the employer (Council). These reviews are confidential to the employee and employer and documentation related to these reviews is withheld under section 50 of the Privacy Act 2020.

In addition, the CE’s performance reviews have previously been undertaken by the Chief Executive’s Performance Review Committee and then reported to Council. Both the Committee reports and associated minutes are included in the confidential part of the Council agenda/minutes as per section 7(2)(a) of the Act ‘to protect the privacy of natural persons’. The minutes resolve not to release either the report or minutes. These documents are therefore withheld under clause 7(2)(a) of the Act.

Following the 2022 election, future CE’s performance reviews have been delegated to full Council to be discussed in the confidential session as per the above.
