Proposed Plan Change 8 - Natural Hazards - to the Rotorua District Plan

Clause 7, First Schedule, Resource Management Act 1991

Rotorua Lakes Council advises that:

  • a summary of the submissions on Plan Change 8 Natural Hazards, including the decisions requested, as well as copies of the full submissions are now available; and
  • the period for making a further submission is open.

Copies of submissions along with a summary of submissions are available at:

Who can make a Further Submission?

Further submissions can now be lodged by:

  • any person representing a relevant aspect of the public interest;
  • any person who has an interest in the plan change that is greater than the interest that the general public has; and
  • the local authority itself.

Further submissions must be received by Rotorua Lakes Council by 31 October 2025.

You may make a further submission by completing and lodging an electronic form on Participate.

Alternatively you can submit your typed/written submissions to Rotorua Lakes Council by:

  • Emailing Policy.Planning@rotorualc.nz, or
  • Posting it to Rotorua Lakes Council, DX Mailbox JX 10503, Rotorua 3046, or
  • Lodging your submission in person at the council office at 1061 Haupapa Street.

What can a Further Submission address?

A further submission must be limited to a matter in support of, or in opposition to, an initial submission.

Within 5 working days of providing the further submission to council, you must also serve a copy on the person who made the original submission. The address for service can be obtained from the list published on the council’s website or by emailing Policy.Planning@rotorualc.nz.

Status under Plan Stop

Section 80Y, Resource Management Act 1991

Background:

Recent changes to the Resource Management Act 1991 require councils to withdraw any plan changes to district plans (and other planning instruments) that have not yet reached a hearing, unless they are covered by an “automatic exemption” under section 80U of the Act, or have been granted an exemption by the responsible Minister. Councils must also give public notice of the status of any proposed plan changes.

Status of Plan Change 8:

Proposed Plan Change 8 (Natural Hazards) to the Rotorua District Plan was notified for submissions before the amendments took effect but has not yet reached a hearing. This plan change is allowed to continue under the automatic exemption in section 80U(2)(f) of the Act for ‘a proposed planning instrument or draft planning instrument that relates to natural hazards’.

Summary:

  • No part of Plan Change 8 has been withdrawn.
  • Plan Change 8 will continue under the automatic exemption for natural hazards.
  • No application for exemption was required, and no Ministerial direction applies.
  • Rotorua Lakes Council is therefore continuing with the process for Proposed Plan Change 8.
